Establishment of an Electronic Mailbox for a Public Authority
The Ministry of Investment, Regional Development and Informatization of the Slovak Republic shall establish an electronic mailbox for every public authority without undue delay after becoming aware of the establishment of the public authority (pursuant to Act No. 305/2013 Coll. on e-Government).
As there is no relevant reference register of public authorities (hereinafter referred to as “public authorities”), the entity responsible for establishing electronic mailboxes does not have the data required to establish their electronic mailbox. For this purpose, Government Office of the Slovak Republic Decree No. 438/2019 Coll., implementing certain provisions of the e-Government Act, stipulates that public authorities must notify the Government Office of their basic data.
In particular, the following information must be provided:
name and registered office address,
type of public authority,
organization identification number,
tax identification number,
bank details; account number in IBAN format,
e-mail address,
telephone number,
identifier of the head of the public authority.
In paper form
A public authority shall use the Data Notification FormOpens in a new windowfor the purpose of reporting its data required for the establishment of its electronic mailbox pursuant to the Act, as published on the central public administration portal.
The form must be submitted in paper form and sent to:
National Agency for Network and Electronic Services Tower 115 Pribinova 25 811 09 Bratislava Slovak Republic
The application must bear the officially certified signature of the head of the public authority.
Electronically
For the purpose of establishing an electronic mailbox for a public authority, an electronic form available in theFind a ServiceOpens in a new window section of the Central Public Administration Portal may also be used.
For the electronic form to be successfully processed and submitted, the user must log in to the central portal as a natural person (the head of the public authority). After completing all mandatory fields, the form must be signed with a qualified electronic signature (QES).
If a public authority has an organizational unit, or if it has under its founding authority an organization without legal personality, it may request the Ministry of Investment, Regional Development and Informatization of the Slovak Republic to establish an electronic mailbox for such organizational unit or organization as well, provided that there are justified reasons for them to have separate electronic mailboxes for the purposes of electronic delivery.
Such a request must be submitted using the designated form. The electronic forms required to establish and administer an electronic mailbox for an organizational unit are available under the “Institutions” tab on the portal's homepage. The “Institutions” tab becomes available only after logging in to the portal on behalf of the public authority.
The rights of the holder of an electronic mailbox established in this manner shall be exercised by the public authority at whose request the mailbox was established.
For each electronic mailbox, its holder has access to information and records concerning:
the electronic mailbox identifier,
the identifier of the person/mailbox holder,
the date and time of establishment, activation, deactivation and cancellation of the mailbox,
the date and time of each access to the mailbox,
the date and time of any change to the rights and permissions associated with the mailbox,
the date and time of sending and receiving an electronic message, including the identifier of the person who logged into the mailbox or sent the message,
the entity that is or was, in addition to the mailbox holder, authorized to access and manage the mailbox, including the scope of its authorization.
Every public authority for which an electronic mailbox has been established pursuant to Act No. 305/2013 Coll. on e-Government automatically has access to the “General AgendaOpens in a new window” electronic service on the Central Public Administration Portal.
This service is available to the public on the portal under the “Electronic ServicesOpens in a new window” section. Using the “Find a Service” electronic service search engine, it is possible to search for the recipient of a submission according to various categories, such as the name of the public authority.
Under the e-Government Act, public authorities are obliged to accept electronically delivered messages every day.
